After clicking on donate link.. I found that,, minimum contribution through paypal/credit/debit card is 100$..
Can I donate 50$ as one time contribution by writing check on IV name and post it through USPS?
Please do not scold me for deciding to donate this much small amount.. My budget supports this much only at this moment.

My friend got EAD.His wife is on F1 visa.If he starts using EAD instead of applying for H1 extension, Can he able to join his wife to his GC process who is currently on F1 when his priority date become current.His priority date is Sept06.140 Approved.july 2, 2007 filer.485 is pending.

I doubt it, as the only issue I am aware of is some concerns about noise, and that doesn't seem big enough to do a recall

Just went thorugh this 3 weeks ago. Same case as yours both for me and my wife. Wrong date stamped on my I-94 while returning from India.
Called the local international airport cutoms division and they made me come down to the airport and after showing the correct documentation issued new I-94 cards with correct I94 dates. Try this and you should face no problems i hope.
I'm from Michigan and i went to the Metro airport in detroit.

I have similar situation with my EAD renewal too, my employer filed my EAD renewal, my I-485 case is pending in TSC (txed from NSC) but my renewal was sent to NSC, when enquired, following is the response I received back from my companies Immigration group,
"Renewal applications are filed based on the location of your residence, as per CIS requirements"
I am based out of MN, hence NSC.

I need some advice.
I have a PD of November 9th 2001 (EB3).
My 140 and 485 was filed on August 2003.
My 140 was approved in Feb 2004.
I am now retrogressed with the November Visa bulletin showing an April 22nd 2001 PD for EB3.
As we can all see EB3 is move very very slowly and probably will continue this way (I hope I am wrong), while EB2 is already current for my PD.
From my information and some threads on this forum. I believe I have the option of filing for an EB2, while maintaining my current PD.
My Questions:
1. Does it make sense for me to refile in EB2, given my situation? PD Nov 2001 in EB3.
2. Can I apply for EB2 through the same company. (my current company)?
3. What is the process of doing so (EB3 to EB2)? Would I have to refile for labor, 140 and 485, or is their a way I could directly file for I485, since my I140 is approved and I am in the same company.
4. Would the EB2 case be a new case altogether, i.e. not related to my existing EB3 case again providing the fact that I have NOT changed employers?
5. Would I be able to use the experience I have gathered in my current job (5.5 years) in the EB2 conversion.
I will appreciate your help.

I'm also in the same situation. My attorney says wait till USCIS figures out that there are duplicates and sends a notice to withdraw one of the petitions. Of course, the checks would be en-cashed for both the petitions.

Yes (assuming you stayed in Canada for less than 2 weeks or whatever is that number).
Or one has to go and get the visa stamped to qualify as lawful entry??
Also when you go to Canada and come back Without VISA stamping, he gets the same I-94 or different I-94??

If you did not submit your old I-94 at the time of entering canada, then you keep the same I-94. In fact, if you do not have a valid visa stamp (i.e., you are entering using visa revalidation), then it is best not to submit your current I-94.

On an average 65k/year non-Immigrant VISAS are issued by immigration services. The Dept. of State claims that 60k immigrant VISA numbers exhausted by June 29, 07. The total number of applicants in the rat race should sum up to at least 260k as on June07.

The June07 bulletin priority dates for India trace back to EB3-June03 & EB2-April04. At the same time about combined ~65k*4(June03-June07) = 260k were looking forward to get ahead in the rat race. Assume that 70% of 260k i.e. 182k had approved labors/substitution labor. The 182k caused to exhaust the 60k available immigrant VISAS then still about 102k are left in the air as non-immigrant alien workers.
The suck-more theory�
Since, the bulletin was issued on June 13, 07 (13 = dooms day) ~102k rushed to local stores like Sears, Walgreen, CVS for 2�� * 2 �� passport size photographs. The non-immigrant alien workers spent around 182k* ~$60 = $10.9mil for 6 passport size photographs. This explains why Walgreen (WALG) which was trailing at $43.xx on NASDAQ in May07 shot up to $45 in June07 and suddenly tumbled down to $43.xx after the revised bulletin. Certified civil surgeons to perform medical examination pocketed medical history�s best earnings in a span of 2 weeks raking revenues of about 182k* ~$275 = ~$50mil. NASDAQ touched years best @2650 in June07. Immigration lawyers charge about $1500 for I140 petition. Market rates for immigrant 485 petition is about $1400 for principal applicant and extra $750 for each dependent. Assuming that the average spending of 182k(singles, married, 2/3dependent applicants) amounted to $2000 for I140 and $2000 for I485 this totals to about 182k*$4000 = guess what!! $728mil. This means that there should be tremendous sales of Bentleys, Porsches, Lexus, Audis, BMWs this year. Projected sales of luxury cars should touch around $500mil for luxury cars alone in Q3. Till the next Oct07 bulletin keep the retro-guess-on for numbers.

Guru, I intend to seek your opinion/thoughts on some thing that is going on in mind.
I am working as a contractor for a Insurance Company. My GC process is started thru a desi consulting company. Priority date is Jun 2007 EB3 - India
The company is now offerring me to join them as permanent employee. They are saying they can help me with immigration.
My question is .. I dont understand how they can help me. I think the best they can do it apply as EB2 - India. (Which we heard recently is no better then my current EB3 India.)
Am I missing anything here ? Trying to make up my mind one way or the other (to accept this position or not.)

Hi,
My wife filed her LC under EB3 with June 2003 priority date and I filed my LC under EB2 with Feb 2005 Prority date. Later, I had a job change, in the same company and had to re-do my LC/I-140 -- this time the LC was filed in Nov 2006. My lawyer requested retaining of my original Feb 2005 priority date.
Later when the floodgates opened in 2007, I filed for my I-485 (and my wife's) and a month later she filed her I-485 (based on her independent application and also added me as a spouse to that application).
So now we have the following situation.
1. We both have two A- numbers (Because I filed for her I-485 on my application and she filed for mine on her application)
2. We now have three different priority dates
Feb 14th 2005 � my original EB2 application
Nov 2006 � my EB2 re-application
June 2003 � my wife�s original EB3 application
Most people with Feb 2005 Priority dates have already received their Green Card approvals. I have not and we got concerned.
We contacted USCIS and they have told us that the file is "under review". We asked what Priority date are they using and the immigration officer said he cannot tell us that because the file is under review.
My questions are
1. How do I find out what priority date are they using?
2. What should I ask my lawyer to do to ensure that USCIS uses the right priority date?
3. I have an info-pass appointment on August 3 (my wife's appointment) -- what should I ask them? I went to them last week and got very little to no information. They did say my name check is complete and fingerprinting is complete, and that the case is sitting with an officer for review.

Graduated from college last year, finally found a job that I really like. Currently on OPT. Just curious to know how long will it take for employer to apply for labor and I-140.
I know most of you are thinking - "are you mad, esp with current gc situation? " the thing is I like it here. My relatives and friends are here. I am hoping that with so many people stuck in the gc process, somebody has to fix it soon - and I (& other newcomers) will benefit from better immigration policy.

but we sent out the application package on June 28 (Friday) and the USCIS received our package on July 1st (Based on the Fedex tracking record). There is no way that my employer can refer to the new prevailing wage databse, which is released on July 1st.
Well, technically your employer is not supposed to set the wage based on the prevailing wage (or any other immigration related number). Your wage should be based on the job you perform.

My H1 expires next week and I am having my FP date 11/13.My company HR recommends that I don't need to go for the 8th year extension.They say that it is a kind of money and time waste to go for extensions.They say that it is good to work on EAD.But my question is what happens if there is a pro with I485?What do you guys recommend????
Can you guys tell me the forms that have to be filled for H4 Extensions.I want to save the $$$that I have to pay for the attorney.

Thanks for your answer. I think it is time to pack then. I am here from 1998. 140 cleared. My Labor was filed in May 2003.
