I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.
My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are
1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

Hi, I wanted to know if it is possible for me to maintain my H1 status (and my wife's H4) status while re-entering the US using I-131 Advance Parole document without a valid H1 visa stamp in my passport.
Here's my situation: -
1. I have been on H1 status for the past 6+ years.

I just found out that my employer did not update the work location on my LCA. I have been working in new jersey for over 4 years now. I have my primary address as Indiana and my company is registered in Illinois. I got payroll on Illinois for 2 years and now NJ for 1 year. How can i correct this? Is it too bad a problem already?
I don't know what location was listed on the LCA, but since you moved before a new LCA was filed, the employer needs to file a H-1B amendment to correct the situation. If there was a new LCA filed before you moved, no H-1B amendment would have been needed.

I am in a worst scenario , just changed a job couple of months ago. I have labor and I-140 approved from Company A. I have even paid $6000 to company A to sponsor my GC and $5500 for a visa transfer. After joining company B i didn't start labor again. Begging Company A to give an employement letter , they have even cancelled my H1b visa so I can't join them back unless i pay H1b visa transfer fee and a pay-cut. Wondering if it is even worth it ?

Please advise me regarding my situation
My current H1B expires May 1s1 and I have my H1B extension pending (in lieu of GC pending with the same company, and EAD is not an option for me because of dependents) with a fortune 500 company A, with whom I am employed. They plan to do a round of layoffs in a couple of weeks that I am sure my team is a part of.
With the foreknowledge of pending situation, please let me know if I can validly take the following course of action.
I am thinking that I premium process my 3 year H1extension with company A right away, then have it transferred to company B. Only problem is extension starts in a future date, ie May 1st.
Can I get my current+extended H1B transferred to company B even before the start date of extended May1st . If I have to wait till May1st to get it transferred, does it matter that on May 1st I am not with company A anymore.

there is another LUD on my 485 today, continuosly from the last 4 working days Dec6th,7th,10th and today(11th)..not sure what's going on...:confused:
It could be anything. Did you get your biometrics taken recently? People normaly would get updates after that. The first meaningful update would be something like "On xxxxx we have ordered your (green) card production". If you got that, you know you got your green card. But your PD is late than current processing date, they wouldn't adjudicate your case, even your name check is cleared. Is your name check cleared?

Check recent visa bulletin. Now a days, bringing spouse by Citizen and GC holders are of not much difference. Go to India and do the marriage, and come back and file I-130. December bulletin calling for August 2010 filers. Forget about H1B and F1.

If they reject the application if a signature or something is missing. Can we refile again? Or do we wait for PD to become current again.
In my oinion,
1) you can file again before August 17th if you got a rejection notification well before that.
2) If you may not be able to send proper application till August 17th then yes you will have to wait till PD becomes current again

�Can I be in H1b and still work another job as a part-time?
�If my wife wants to work using her EAD does it have any effect on her h4 status?
�If my wife loose her job during the use of her EAD what will be her status?
�I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
�I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?

A good lawyer is worth every penny.
You, on the other hand, should play your part by being "aware" and not blindly relying on the lawyer. Your job should be to double check documents for accuracy/correctness and asking questions to the lawyer and IV to clear doubts. Making sure the lawyer is abiding by all the immigration rules as defined by the law would be another task.

Did you ever used EAD? Just getting an EAD does not mean you were on EAD.
Also AP does not invilidate your H1. If you are working with the H1 sponsoring employer and never used EAD, then you need not worry.
