I guess we should ask them to remove the employer's restriction, which is the prime reason for extreme exploitation. H1b should not be restricitive. IV should also address the same. We are looking at the current problem with retrogression only, but what about future aspirants who come on H1.

Does anyone know what is the current count on H1-B Visas left for the year 2006-07 ?
I know I may sound stupid and probably the answer is that it is already complete, but wanted to confirm.
Also, when would the next years quota become available and when can one start working at the earliest ?
Is there any other way to file for H1-B now and work..?

My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

Watch for April VISA BULLETIN, The DOS publishes this ususally sometime in first 2 weeks of each month for the following month. If the Date moves forward you should be able to file sometime in April, assuming the Date moves forward. Also you can use this time to prepare the application.

So basically while I'm waiting for the priority date to become current, I can legally work aborad for several years without any harm to my GC application at all. When the priority date becomes current, I'll just need to come back to the U.S. to file I-485.

Hi Simi,
The fact that the company that sponsored your GC shuts down or files for bankruptcy should not have any impact on you. As long as you have an approved I-140, an I-485 pending more than 180 days and a job offer in the same or similar occupation, you are protected by AC-21.
It would be prudent to make sure that you now have copies of all documents relating to your GC case, including complete copy of LC, I-140 petition and supporting docs, H petitions, pay records etc.

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

I'm on OPT right now ,i'm done with my masters in DEC 2007.
My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 24 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.
I did't apply in 2009 even i have chance to apply(because of the JOB fear ) i got my OPT extension approved ,my OPT extension is going to end in June 2010 , any way i will be applying H1B in 2010.
My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

If yes, on whose name should we register the company ? Should I register on my name or is it anyway safer to register on my wifes name?
